Service Agreement

Effective Date: February 17, 2026

This Service Agreement ("Agreement") is between Jack Oval Group LLC ("Photographer") and the person or entity requesting services ("Client"). By booking a shoot and submitting payment, the Client agrees to the following terms:

1. Ownership & Copyright (ARMLS Compliance)

Pursuant to the ARMLS Preferred Photographer Program, Photographer retains full copyright ownership of all media ("Works").

  • Grant of License: Photographer grants Client a non-exclusive, non-transferable license to use the Works solely for marketing the specific property for the duration of the listing.

  • Prohibitions: Third-party usage (builders, stagers, or subsequent agents) is prohibited without a separate licensing agreement.

2. Portfolio & Marketing Rights

Photographer reserves the perpetual right to use all Works for corporate marketing, social media, and portfolio displays, regardless of the property's sale status.

3. Property Readiness & "As-Is" Policy

Properties are photographed "As-Is."

  • Readiness: The Client is responsible for ensuring the property is clean and photo-ready at the scheduled start time. Photographer does not provide cleaning or staging.

  • Access: As an ARMLS Affiliate, Photographer is authorized to access the property via Supra eKEY or provided codes.

  • Failure to Access: If Photographer cannot gain access or the property is not ready, the pre-paid service fee will be applied to the lost time slot and is non-refundable.

4. Inclement Weather & Heat

Extreme Arizona weather (Monsoons, dust storms, or lightning) may pose a safety risk to equipment. Rescheduling due to extreme weather is at the Photographer’s discretion and will not incur a fee.

5. Payment & Delivery (Pre-Paid Service)

  • Confirmation: All services must be paid in full at the time of scheduling. No appointment is confirmed, and no time slot is reserved until payment is successfully processed via Squarespace/Stripe.

  • Delivery: Final media is typically delivered via digital download within 24–48 hours.

  • Licensing: The license to use the media is granted only upon delivery. If a payment is reversed or disputed, the license is revoked immediately.

6. Limitation of Liability

Photographer is not liable for pre-existing property damage. Client agrees to indemnify Photographer against all claims arising out of the use of the Works or property access.

7. Governing Law

This Agreement is governed by the laws of the State of Arizona, with venue in Maricopa County.

8. Satisfaction & Reshoots

  • Review Period: Client has 48 hours from delivery to review media. Issues due to technical errors (blurriness, missing rooms) will be corrected at no additional charge.

  • Subjective Feedback: Photography is subjective. By booking, Client accepts the Photographer’s artistic style as seen in the Portfolio.

  • Reshoot Fees: Requests for reshoots due to artistic preference, weather changes (after the shoot), or property changes (new furniture/cleaning) are billed at 75% of the original session cost.
